LooVaCast Terms and Conditions

Welcome to LooVaCast! These Terms and Conditions (“Terms”) govern your access to and use of LooVaCast’s radio hosting services, which are powered by the AzuraCast platform. By signing up for or using our services, you agree to comply with these Terms. If you do not agree with any part of these Terms, you must not use our services.
1. Services Provided
LooVaCast provides hosting services for internet radio stations using the AzuraCast platform. Our services include server resources, storage, bandwidth, and technical support to manage and broadcast your internet radio stream. We do not provide licensing for music content, advertising services, or any additional rights beyond the hosting service.
2. No Responsibility for Licensing or Royalties
2.1 Music Licensing Responsibility
LooVaCast is not responsible for securing or managing music licenses, royalties, or any related compliance for the content you broadcast. If your radio station streams music, you are solely responsible for obtaining appropriate licenses from performance rights organizations such as ASCAP, BMI, SESAC, SoundExchange, or any other applicable licensing bodies. LoovaCast does provide the needed tools that allows you to track and log your music playlist should you need reporting capabilities for royalty payments, this is offered at free of charge if this is a format you choose.
2.2 Talk Radio and Non-Music Formats
If your radio station exclusively broadcasts talk radio, podcasts, or other non-music formats, you may not need to obtain music licenses. However, it is your responsibility to verify licensing requirements based on your specific content.
3. Reason for Low Rates
Our hosting rates are intentionally kept low because:

3.1 No Advertising Charges
LooVaCast does not charge for advertising, and we do not place any advertisements on your streams. You have complete control over your content without interruption from ads inserted by us. -
3.2 No Licensing Fee Inclusions
Our rates do not include any music licensing fees. As stated in Section 2, obtaining and managing music licenses is your responsibility if your stream includes music. -
3.3 Focused Service Model
We focus exclusively on providing reliable and affordable hosting for the AzuraCast platform without additional costs for licensing, advertising, or content management.
4. Content Responsibility
4.1 User Responsibility for Content
You are solely responsible for the content you broadcast, including music, speech, and any other material. LooVaCast does not review, monitor, or endorse your content.
4.2 Compliance with Laws
You agree to comply with all applicable laws, regulations, and licensing requirements related to your broadcast content.
5. Limitation of Liability
LooVaCast shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from:
- Your failure to obtain proper music licensing.
- Legal actions arising from unlicensed content broadcast on your station.
- Loss of revenue or other damages resulting from interruptions in your stream.
6. Termination
We reserve the right to terminate your account without notice if we receive credible information that your content is in violation of applicable licensing laws or these Terms.
7. Indemnification
You agree to indemnify and hold LooVaCast harmless from any claims, losses, damages, liabilities, including legal fees, arising out of:
- Your failure to obtain necessary music licenses.
- Your broadcast content violating any third-party rights or applicable laws.
8. Amendments to Terms
LooVaCast reserves the right to update or modify these Terms at any time. Continued use of our services following any modifications constitutes acceptance of the updated Terms.
